And now Elon Musk’s X is in hot water after they stood up for Donald Trump’s Constitutional rights with one epic act of defiance.
Twitter fought court order to hand over Trump account information on Constitutional claims
Elon Musk found himself between a rock and a hard place just months after his acquisition of Twitter, a newly released court document shows.
In January 2023, Twitter – now known as X – was ordered by Special Counsel Jack Smith to surrender access to former President Donald Trump’s account on the platform.
The warrant was approved on January 17, and ordered the company to “produce information the government related to the Twitter account ‘@realDonaldTrump,’” and compelled the company to refrain from “notifying anyone about the existence or contents of the warrant.”
Twitter appealed the warrant, arguing “that the nondisclosure order violated the First Amendment and the Stored Communications Act; that the district court should have stayed its enforcement of the search warrant… and that the district court abused its discretion by holding Twitter in contempt…”
Musk’s company did everything it could to fight the execution of the warrant, but eventually, time ran out.
X paid the price for standing up for users’ rights
The appeal ultimately failed, and X ended up on the other side of the deadline that the court set.
The court recognized that the company’s lawsuit “delayed production of the materials required by the search warrant,” but hadn’t allowed for an extension in lieu of the court’s decision.
Following the unsuccessful appeal, X was then forced to produce the materials requested by Smith.
However, the court said, “although Twitter ultimately complied with the warrant, the company did not fully produce the requested information until three days after a court-ordered deadline…”
Despite the argument by X that “the court should have stayed its enforcement,” the district court followed suit with the Washington, D.C. Court of Appeals, and “held Twitter in contempt and imposed a $350,000 sanction for its delay” in producing the materials Smith demanded.
Needless to say, Trump, Musk, and X aren’t happy with this outcome.
Trump says this proves America is in “DARK DAYS”
In opposing the decision, X argued “that by keeping the warrant secret from Trump, he would be unable to shield communications made using his Twitter account from prosecutors by asserting executive privilege,” and that the government was violating the constitution by ordering them not to communicate with the former President.
Trump raged against the court decision and the Biden regime in a post on Truth Social.
He accused the regime of “secretly” attacking his account, and “making it a point not to let [him] know about this major ‘hit’ on [his] civil rights.”
He said that President Biden was “going crazy trying to infringe” on his campaign.
“Nothing like this has ever happened before,” Trump added. “Does the First Amendment still exist? Did Deranged Jack Smith tell the Unselects to DESTROY & DELETE all evidence? These are DARK DAYS IN AMERICA!”
This gross violation of the Constitution truly does show that America is in dark times, and has a long way to go before anything gets better.
