All of Donald Trump’s biggest enemies are relentless in trying to take him down.
They’re even using the Department of Justice to come after him.
But Donald Trump just got a huge win that left Merrick Garland enraged.
The Feds seized “medical documents” and went through Melania and Barron’s living quarters
When Donald Trump’s home was raided by Biden’s DOJ a lot of heads turned.
As weeks go on, even more details have been coming out.
Trump has been very vocal about it, even sharing that, “they rifled through the living quarters of my 16-year-old son, Barron, and the loved and respected former First Lady of the United States, Melania . . .”
They seized over 500 pages of material that could be covered by attorney-client privilege.
It was even reported by Daily Mail that they seized, “medical documents, correspondence related to taxes, and accounting information,” items all beyond the scope of the warrant.
Donald Trump labeled it a “break in” and quickly requested a special master to do an independent review of materials seized.
His lawsuit cited the extent of their search and the exclusion of Trump’s legal team.
Attorney General Merrick Garland quickly made the claim that this would never happen.
The raid amounted to “reputation harm of a decidedly different order of magnitude”
Now a Florida Federal Judge by the name of Aileen Cannon has made her order.
In her ruling she states, “A special master shall be APPOINTED to review the seized property, manage the assertions of privileges . . . and evaluate claims for the return of property.”
This ruling was a huge win for Trump as he repeatedly requested that items be returned.
Now the DOJ may have to grant some of those requests.
The next step according to the order is for both parties to submit a joint filing that includes a list of candidates and a proposed order of appointment.
She cited several reasons to support her decision, including the risk of government leaks.
She recognizes that “In addition to being deprived of potentially significant personal documents, which alone creates a real harm, Plaintiff faces an unquantifiable potential harm by way of improper disclosure of sensitive information to the public.”
She was also concerned about the impact on Trump’s reputation saying, “the stigma associated with the subject seizure is in a league of its own. A future indictment, based to any degree on property that ought to be returned, would result in reputational harm of a decidedly different order of magnitude,” especially because he is a former President.
Judge Cannon argued “the Government has not clearly explained how Plaintiff’s hands are unclean”
The DOJ has made the argument that Trump should have no right to discuss what they took.
Judge Cannon however stood beside the Fourth Amendment with this response, “Plaintiff has not pled guilty to any crimes; the Government has not clearly explained how Plaintiff’s hands are unclean with respect to the personal materials seized; and in any event, this is not a situation in which there is no room to doubt the immediately apparent incriminating nature of the seized material.”
This is a huge development in the Mar-a-Lago raid, and we know Garland was crushed by it as the DOJ decided to appeal the decision.
President Trump always spoke about how important his federal Judge appointments were.
Just as promised, they are doing their jobs and standing for the Constitution.
